National Organization of Peer Educators (NOPE) invites sealed bids from eligible tenderers for the purchase of a Toyota Land Cruiser Prado KBP 162E. A Tender form may be obtained by interested candidates upon payment of non-refundable fee of KES 5,000. Buyers should note that they will be required to pay Duty and Taxes upon successful purchase and therefore prices quoted should be the net exclusive of all taxes in Kenya shillings. The prices shall remain valid for 120 days from the closing date of the tender.

Tenders will be opened 2 days after the closing date and the successful bidder(s) will be notified in writing in the subsequent week.

SECTION B:  INSTRUCTIONS TO BIDDERS.

 

The National Organization of Peer Educators (NOPE) is a registered a Kenyan NGO with international mandate working within the Africa. NOPE implements various programs and services including: health programs, including HIV/AIDS, Family Planning and Reproductive Health, Strategic Behavioral Interventions (SBIs) and democracy and governance interventions mostly in East Africa.

This disposal process which is in line with its CDC CFR45 document, part 74 and NOPE procurement policies and procedures, seeks to sell a Toyota Land Cruiser Prado 4 x 4 to the public through open tendering. The NOPE procurement committee select eligible bidders from submitted tenders using the following method:

  1. All tenders must be placed in the tender box.
  2. This is an internal process and no witnesses will be necessary at the time of opening the tenders.
  3. The procurement committee will record all tenders with the quoted prices.
  4. The most competitive bid will be selected on the basis of price, method of payment, declaration of conflict of interest and background information provided.

Qualification

This Invitation for Tenders is open to any individual, company, government body or Non-Governmental Organization. NOPE employees and members of the board are eligible to apply as long as they openly declare the possible conflict of interest.

NOPE will disqualify any bidder who engages in fraudulent or corrupt methods to gain tendering advantage. NOPE does not pay commissions to brokers.

 “Corrupt practice” means the offering, giving, receiving, or soliciting of anything of value to influence the action of a NOPE officer in the procurement process or in contract execution; and

“Fraudulent practice” means a misrepresentation of facts in order to influence a procurement process or the execution of a contract to the detriment of the procuring entity, and includes collusive practice among tenderer (prior to or after tender submission) designed to deprive the Procuring entity of the benefits of free and open competition.

Cost of Tendering

The Tenderer shall bear all costs associated with the preparation and submission of its tender, and the NOPE will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the tendering process.

The price to be charged for the tender document shall not exceed five thousand Kenya shillings (KES 5,000).

Clarification of Documents

Prospective tenderer requiring any clarification of the tender document may notify NOPE in writing through an email and send to tenders@nope.or.ke  and copy anjuguna@nope.or.ke . NOPE will respond within 24 hours in writing by email to any request for clarification on the tender documents, which it receives not later than Three (3) days prior to the deadline for the submission of tenders.

Amendment of this Document

At any time prior to the deadline for submission of tenders, NOPE, for any reason, whether at its own initiative or in response to a clarification requested by a prospective tenderer, may modify the tender documents by amendment. The changes will be done in good time to allow tenderers to submit their bids with corrections.

Tender Form

The tenderer shall complete the Tender Form and the appropriate Price Schedule furnished in this tender document.

Tender Prices

The tenderer shall indicate on the appropriate Price Schedule the price and total tender price of the bid. Prices indicated on the Price Schedule shall NOT include transfer fees, taxes and duty, insurances and delivery. All prices must be in Kenya Shillings (KES/Ksh.)

Withdrawal of the Tender

NOPE shall give prompt notice of the termination to the tenderers and on request give its reasons for termination within 5 days of receiving the request from any tenderer. In case of a withdrawal all money paid will be refunded through MPESA transfer.

NOPE’s right to accept or reject any or all tenders

The NOPE reserves the right to accept or reject any tender, and to annul the tendering process and reject all tenders at any time prior to without thereby incurring any liability to the affected tenderer or tenderers or any obligation to inform the affected tenderer or tenderers of the grounds for NOPE’s action.
